ISLAMABAD – PTI Chairman Imran Khan has been granted pre-arrest bail by a District and Sessions Court in Islamabad. The court’s decision was delivered in writing on Saturday, providing a detailed explanation for the ruling.
The court presided over by Additional Sessions Judge Farrukh Farid, emphasized that the prosecution must establish that the accused was the instigator of the offence. The judge pointed out that there have been misinterpretations of the clause pertaining to incitement or conspiracy in the past.
The written judgment further clarified that a clear connection between the act and the conduct of the crime must be established. This implies that it must be proven that the offence occurred as a direct result of provocation.
Interestingly, the judgment debunked claims that Imran Khan, who was under the custody of NAB at the time of the crime, had orchestrated the offence during his unlawful arrest. The court’s ruling stated, “Framing a person in a criminal case in such a manner is absurd and reveals malicious intentions on the part of the police.”
