- The government says the court overstepped its authority in granting bail to Azam Swati.
- It has demanded cancellation of Swati’s bail as soon as possible.
- The PTI leader was arrested last month. Released a week later.
ISLAMABAD: The ruling coalition on Wednesday moved the Islamabad High Court (IHC) seeking cancellation of bail in the case of PTI leader Azam Swati’s controversial tweet.
The federal government filed this application at the IHC through Federal Investigation Agency (FIA) Technical Officer Anisur Rehman.
In its petition, the government said that Special Judge Central Raja Asif Mehmood exceeded his powers by granting bail to Azam Swati.
A judge last month granted bail to the senior PTI leader on a surety bond of Rs 1 million, more than a week after he was arrested by the anti-corruption watchdog.
Senator Swati was detained by FIA’s Cyber Crime Wing (CCW) on October 13 from his residence in Islamabad after a case was registered over his controversial tweets.
“The court was competent only to the extent of PECA 2016 and not other sections of the PPC but, by exercising powers over all the sections, the court traveled beyond the jurisdiction. Therefore, non- There is a legal order”.
“This learned judge has ignored the aforesaid provision and has passed an order in a slipshod manner and in fact has tried to avoid the aforesaid provision of law, therefore, the order is not sustainable and without jurisdiction.”
In light of the arguments, the government requested the IHC to accept the application at the earliest and grant bail under Section 109 (if committed as a result of the Act and where there is no express provision for punishment). ), 131 (inciting mutiny, or attempting to seduce a soldier, sailor or airman from his duty), 500 (punishment for defamation), 501 (printing or engraving matter known to be defamatory); is), and 505 (statements conducive to public riot) should be repealed.
‘filmed’
In a press conference a day ago, the PTI leader had alleged that he was taken to an unknown location where he was filmed during his detention.
While addressing a press conference in the federal capital, Azam Swati thanked Chief Justice Umar Atta Bandial for reviewing his arrest on behalf of FIA.
Swati said that valuables were taken from her house during the search. “I don’t care that they took my life but they insulted my dignity,” he added.
The PTI leader demanded the Supreme Court to take custody of the CCTV cameras installed around his house. He added that they should be sent for forensics so that the court would know how many people entered their house.
He kept saying that half of the evidence in his case was filmed in CCTV cameras. “They also took CCTV cameras as backup,” he added.
‘violence’
In a press conference last month, PTI chief Imran Khan claimed that law enforcement agencies entered the former federal minister’s residence without a warrant.
“Azam Swati was tortured in front of her children, what crime did Azam Swati commit, just that she criticized a person holding a high position.” Khan asked.
The PTI chief asked which country allows the authorities to arrest a person on the basis of a critical tweet?
“The most terrible thing is that Azam Swati was handed over to someone else, who were the people who were handed over?” Khan asked.
